TERMS OF SERVICE
The service
Neoku is an AI Workflow Orchestration (AWO) and Business Process as a Service (BPaaS) platform. We do not give you software to operate yourself. We design, build, and run AI agents that execute business processes on your behalf — customer support, lead qualification, booking, and similar repeatable workflows. What we run for you is described in the workflow blueprint you reviewed and accepted at checkout.
Payment
- Subscriptions are monthly recurring, charged in advance via Stripe.
- You can cancel any time from your account or by emailing us. Cancellation takes effect at the end of the current billing period.
- No refunds are issued for partial months, unused service, or change of mind. The only exception is the performance credit described below.
Performance credit guarantee
If a Neoku agent delivers a response that materially harms a customer interaction — not just an imperfect answer, but a genuinely damaging one — that month is credited free.
- Whether harm was “material” is determined by Neoku at our discretion, in good faith, on the merits of the conversation.
- Claims must be submitted by email with a screenshot or transcript reference within 30 days of the interaction.
- Every conversation handled by a Neoku agent is logged, so any claim is verified against the actual transcript before a credit is issued.
“Live in 7 days”
We commit to having your first agent in production within 7 business days of payment, defined as the agent receiving and responding to a real customer interaction in your environment. If we miss that mark for any reason on our side, your first month is free — applied as a credit on your next invoice. Delays caused by your tools, integrations, or our inability to obtain access we asked for in onboarding don’t count against the 7-day clock.
Your data
You own your data. Customer conversations, business information, and any content the agents process on your behalf remain yours. You can request export at any time. On cancellation we delete your data within 30 days of a written request to hello@neoku.site. See our Privacy Policy for full detail.
Acceptable use
You agree not to use Neoku to:
- Send spam, phishing, or fraudulent messages.
- Impersonate another business or individual without authorization.
- Process content that is illegal, infringes a third party’s rights, or violates the terms of any platform we integrate with (Google, Meta, Stripe, etc.).
- Attempt to reverse-engineer or compromise our systems.
We reserve the right to suspend or terminate service immediately for any violation of this section, with no refund.
Termination
We may terminate the service for cause (acceptable-use violation, chargeback abuse, prolonged non-payment) at any time. We may also discontinue Neoku as a product with 30 days’ notice and a pro-rated refund of any prepaid period. You may cancel at any time per the Payment section above.
Limitation of liability
To the fullest extent allowed by law, Neoku’s total liability for any claim arising out of or related to the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Governing law
These terms are governed by the laws of the State of Delaware, United States. Any dispute will be resolved in the state or federal courts located in Delaware.
